Taiwan is moving to make smuggling AI chips to China a criminal offence. Minister Kung Ming-hsin confirmed that AI servers and advanced chips will be added to the list of controlled commodities under the Foreign Trade Act, with unauthorised shipments to Chinese buyers carrying criminal liability rather than administrative penalties.

The amendment was drafted by legislator Chung Chia-pin. The shift from fines to criminal exposure is the substance of it: an export-control breach that costs a company money is a cost of doing business, while one that puts named individuals at risk of prosecution changes who signs off on a shipment.

Taiwan sits at the centre of this supply chain in a way no other jurisdiction does, so a Taiwanese criminal prohibition reaches further than an equivalent rule elsewhere. It also lands in the same week TSMC reported record quarterly revenue, with HPC including AI accelerators at 68% of sales.
